UAB “Gempa” Terms and Conditions of Sale and Purchase
1. General Provisions
1.1. Seller – UAB “Gempa”, legal entity code: 123575356, registered address: Kalvarijų g. 125, Vilnius, Lithuania, e-mail: info@gempa.lt, tel.: +370 647 38877.
1.2. Buyer – a natural person who has reached the age of 18, or a legal entity having the legal capacity to enter into contracts.
1.3. These Terms and Conditions govern the sale and purchase of goods in the online store www.gempa.lt and constitute an integral part of the contract concluded between the Buyer and the Seller.
2. Moment of Contract Conclusion
2.1. A sale and purchase contract shall be deemed concluded from the moment when the Buyer:
• forms a shopping cart in the online store;
• provides delivery and contact details;
• selects a payment method;
• reviews these Terms and Conditions and clicks “Place Order”.
3. Buyer’s Rights and Obligations
3.1. To purchase goods in accordance with these Terms and Conditions and applicable legal acts.
3.2. To provide accurate and up-to-date contact and delivery address information.
3.3. To pay the price of the goods and (where applicable) delivery costs.
3.4. The Buyer has the right to withdraw from the purchase and return the goods within 14 calendar days from the date of receipt, provided that the goods meet the return conditions.
4. Seller’s Rights and Obligations
4.1. To sell and deliver goods and to provide accurate information on the price of the goods, VAT, delivery costs, and delivery terms.
4.2. To ensure that the goods are suitable for use for their intended purpose.
4.3. To comply with the legal acts of the Republic of Lithuania.
4.4. The Seller reserves the right to amend these Terms and Conditions; amendments shall apply only to future orders.
5. Payment and Delivery Terms
5.1. Payment may be made by:
• bank transfer;
• bank card;
• other electronic payment methods indicated on the website.
5.2. Goods are reserved only after payment has been received.
5.3. (If the goods are in stock) Delivery is carried out within 2–4 business days from receipt of payment, unless otherwise indicated. If the goods are made to order, the delivery time shall be specified separately.
6. Return and Withdrawal Conditions
6.1. The Buyer may return the goods within 14 calendar days from the date of receipt, provided that the goods are not damaged, have not been used, and are in their original packaging.
6.2. High-quality goods manufactured according to an individual order are non-returnable.
6.3. The paid amount shall be refunded within 14 business days from the date the returned goods are received and inspected.
7. Data Protection
7.1. The Buyer’s personal data are processed in accordance with the UAB “Gempa” Privacy Policy.
7.2. Prior to making a purchase, the Buyer must review the Privacy Policy and confirm consent to its terms.
8. Liability and Dispute Resolution
8.1. The Seller shall not be liable for information or actions on third-party websites if links to such websites are provided in the online store.
8.2. Disputes shall be resolved through negotiations. Failing agreement, disputes shall be resolved in accordance with the laws of the Republic of Lithuania.
9. Amendment of the Terms and Conditions
9.1. The Seller reserves the right to amend these Terms and Conditions at any time.
9.2. Amended Terms and Conditions shall enter into force from the date of their publication on the website. The Buyer must review the Terms and Conditions prior to placing an order.
